[17] Articulating niyyah for Sal?t simultaneously with Takbiratul Ihr?m.
[1/ 17] Articulating niyyah [for Sal?t] is not an obligation not even recommended as the ‘Ulamah agreed. On the contrary it is considered as Bid‘ah. If one does this believing in its legality in the Sahr’, though its ruling is displayed for him; he is indeed an ignorant that should be punished especially those who articulate it loudly causing annoyance for other muslims or say it more than once.
The following are some of the ‘Ulamah’s statements about the prohibition of articulating Niyyah [for Sal?t]:
Q?d? Abur Rab?’ Sulaiman Ibn ‘Umar Ash-Sh?fi’i said: ‘Articulating Niyyah [for Sal?t] and reciting Qur’an with the Im?m are not of the prophet’s ( - صلى الله عليه وسلم -) Sunnah’, on the contrary, they are detested acts. If articulating Niyyah causes annoyance for other muslims in Sal?t, it is then considered Har?m [forbidden]; believing in the opposite is one of the great mistakes. Besides, it is prohibited for any one to deliver rulings about things in religion without having the sufficient knowledge.
Ab? Abudll?h Muhammad Ibn Al-Q?sim Al-T?nis? Al-M?lik? said: ‘Niyyah lies in the heart, so articulating it is Bid‘ah not to mention causing annoyance for other muslims’.
Shaikh ‘Al?’ud Din Ibn Al-’Att?r said: ‘Articulating Niyyah loudly and causing annoyance for other muslims is Har?m. If no disturbance is caused then articulating it is considered Bid‘ah. If this act was done out of dissimulation then it turns to be of the great sins. Those who condemn others for articulating Niyyah are on the right way unlike those who believe in its legality in the religion of Isl?m; they indeed have committed an act of Kufr, or at least a disobedience if they do it out of ignorance. Every muslim should fight this Bid‘ah according to one’s capacity for this act is not of
